Mansfield Community Development Office Six Park Row, Mansfield, MA 02048 Phone:508.851.6410 Fax:508.261.7424 HRPAC Meeting ; ;F. ; `;a° STTS April 14, 2004 f Attendees: Jack Vultaggio, Zoning Board of Appeals Judy Marton, Member -At -Large Doug Annino, Planning Board Ed Tartufo, Citizen Representative Mee Heh Risdon, CDO The meeting began at 3:10 1. The meeting opened with an update on the status of case #14 (See the attached spreadsheet). The discussion then turned to the question of whether the HRPAC would approve a waiver of the local program cost cap so that the program could submit a` waiver request to DHCD. The local waiver was needed because the size of the project was being reduced from a 2-unit to a 1-unit project. Some committee members asked whether there was a way to recover some of the funds paid to the original contractor, especially since some of the work he started had to be redone and he failed to pay the electrician even though the program paid the contractor for the electrician's'work. One idea was pursuing a mechanics lien on behalf of the homeowner. However, the construction contract was between the homeowner and the contractor and the Town was not a party to the agreement. Another member then proposed that the program should obtain a release of lien from the contractor before each payment is released to the contractor instead of waiting for a release after the project is completed. There was a long discussion about whether to grant the waiver at all because many people were concerned that the homeowner was not allowing the program to complete the rental unit at this time and because of the high cost to just complete the owner's unit. However, the members were also concerned that further complaints from the homeowner to DHCD could jeopardize the release of future funds or the awarding of funds in the future. Jack then motioned to approve the waiver with the following conditions: • They will agree to go back and complete work on the rental unit if the program receives FY04 CDBG funds but they will only do this if required by DHCD • The entire amount the program spent on this case is fiend on the house • If the program does have to complete the rental unit then: • No sweat equity will be allowed • The scope of work will be limited only to work required to create a legal 2°" unit and delead the unit. These minutes have been accepted and approved. Date: J 3 D f
