This section presents supporting information. A copy of the unsigned, validated Bureau of Waste Site Cleanup BWSC104 Transmittal Form used to submit this Permanent Solution with No Conditions Statement is included in Appendix A. General Disposal Site Information The Site information requirements for a PSS are provided in this section. The information presented below in bold, italictext corresponds to the requirements specified in 310 CMR 40.1056 of the MCP. a. Disposal Site Name and MassDEP Release Tracking: RTN 4-28584, Mansfield Rest Area, Interstate 95 Northbound b. Category of Solution: Response actions have eliminated or controlled the threat of release of OHM and achieved a Condition of No Significant Risk to human health, safety or public welfare, and the environment for all current and potential future activities and uses at the Site. A Permanent Solution has been achieved, the level of oil and/or hazardous material in the environment has not been reduced to background and an Activity and Use Limitation (AUL) is not required. As such, a PSS with No Conditions has been achieved for this release In accordance with 310 CMR 40.1041(1). c. Method 1 Risk Characterization: The PSS with No Conditions is based on the results of a Method 1 Risk Characterization presented in Section 8. d. Other Permanent or Temporary Solution Statements or further Remedial Response Actions related to a portion of or the entire disposal site: None, e. Indication as to whether Permanent Solution is based upon implementation of an Activity and Use Limitation (AUL) at the Disposal Site: An AUL is not necessary to achieve or maintain a condition of No Significant Risk. f. Indication as to whether Permanent Solution Is based upon assumptions about Site activities, uses or conditions that do not require an AUL per 310 CMR 40.1013: This PSS with No Conditions is not based upon assumptions about the Site activities, uses, or conditions. g. Indication as to whether Permanent Solution is based upon operation of Active Exposure Pathway Mitigation Measures per 310 CMR 40.1025: No Active Exposure Pathway Mitigation Measures are needed or required for this PSS with No Conditions. It. LSP Opinion as 4o whether requirements of applicable category of Permanent Solution have been met: The LSP Opinion is provided in Section 11, and in the BWSC104 transmittal form submitted concurrently with this PSS with No Conditions Statement via eDEP (See Appendix A), f, Certification of Permanent Solution Statement and all documents submitted with Permanent Solution Statement: ATC Permanent Solution Statement with No Conditions Mansfield Rest Area, Interstate 95 Northbound, Mansfield, Massachusetts The Permanent and Temporary Solution Statement transmittal form (BWSC104) and associated LSP Opinion are submitted concurrently with this PSS with No Conditions via eDEP and an unsigned; validated copy is included in Appendix A provide these certifications. j. Indication as to whether OHM in sail and groundwater exceed one or more Upper Concentration Limits: EPCs of COCs in soil do not exceed UCLs. See Table 1. k. Indication as to whether the analytical data used to support the Permanent Solution Statement was generated pursuant to the Department's Compendium of Analytical Methods: Data collected by ATC was collected and analyzed in accordance with the MassDEP CAM required to achieve a status of Presumptive Certainty. Most data collected at the Site meet standard MassDEP CAM QA/QC performance standards and recommendations for field sampling procedures as well as laboratory analytical methods, including: Samples were received by the laboratory in a condition consistent with that described on the chain of custody documentation for the data set; • QA(QC procedures required for the specified analytical method(s) included in the reports were followed, including the requirement to note and discuss in a narrative QC data that did not meet appropriate performance standards or guidelines; • The data included in the reports met analytical requirements for Presumptive Certainty, as described in Section 2.0 of the MassDEP document CAM VII A, "Quality Assurance and Quality Control Guidelines for the Acquisition and Reporting of Analytical Data"; and The analyses were conducted without significant modifications. ATC considers the soil data used as part of this submittal to achieve Presumptive Certainty and to be of suitable quality and valid to use for the intended purpose. Details are provided in Section 6. Supporting Documentation for Permanent Solution with No Conditions The Site supporting documentation requirements for a Permanent Solution with No Conditions Statement are provided in this section. The information presented below in bold, italic text corresponds to the requirements specified in 310 CMR 40.1056(2) of the MCP. a. Clear and accurate description of the location of the site for which the Permanent Solution applies: The Site consists of the extent of the diesel fuel impacts, as described in Section 3.1. The Disposal Site Boundary is depicted on Figure 2. b. A succinct summary of the Conceptual Site Model: The CSM is presented in Section 6.1.1. c. Demonstration that all Sources of OHM Contamination have been eliminated or controlled, as specified in 310 CMR 40.1003(5): There are no uncontrolled sources, as specified in 310 CMR 40.10003(5). The source is the release of diesel fuel was from a truck saddle tank in the rest area. The driver of the track drove out of the rest area without reporting or responding 10 the spill. Since the truck from which the diesel fuel was released was driven from the Site, the release source was eliminated. d. Demonstration that response actions have been taken to adequately assess and control NAPL mobility, as specified in 310 CMR 40.1003(7)(a): NAPL has not been detected nor is it likely to be present at the Site. ATC Permanent Solution Statement with No Conditions Mansfield Rest Area. Interstate 95 Northbound, Mansfield, Massachusetts e. information supporting the conclusion that a level of No Significant Risk has been achieved or exists: A Method 1 Risk Characterization is included as Section 8. f. Information documenting the extent to which levels of OHM in the environment have been reduced to Background, and/or the results of the feasibility evaluation demonstrating that the achievement of Background is not feasible: Groundwater was not impacted by the release. Areas of impacted asphalt pavement were returned to background conditions. EPCs of COCs, including VPH and EPH fractions and target compounds in post - excavation soil samples, met Method 1 standards. Based upon the known diesel fuel release, any detected concentration is considered above background. The feasibility of achieving or approaching Background is documented in Section 9. g. A copy of any and all AULs which have been implemented under 310 CMR 40.1070: Not Applicable. An AUL is not necessary to achieve or maintain a Condition of No Significant Risk and will not be implemented for the Site. h. For Permanent Solutions with Conditions based upon assumptions about site activities, uses, or conditions that do not require an AUL, documentation related to such assumptions and conditions: Not Applicable, 1. A Data Usability Assessment documenting that the data relied upon is scientifically valid and defensible, and a Data Representativeness Evaluation, documenting the adequacy of the data sets used to support this Permanent Solution: A Data Usability Assessment and Representativeness Evaluation is presented in Section 6. j. Description of any operations, maintenance and/or monitoring required to maintain conditions at the disposal site upon which the Permanent Solution is based: Not Applicable. January euer ATC
