Meeting called to order at 7:07 pm. [2. Notice of Intent: .. Joseph &Sally Goyea,2(jOPlain Street -#211-0823. Michael Trowbridge of Hutchins-Trowbridge Associates and Mr. and Mrs Goyea, the applicants, were present. Mr. and Mrs. Goyea had been before Conservation for a new septic system and have received a COC from Conservation and Board of Health. Due to major structural issues, the house will be leveled and a new house will be constructed within the same footprint of the existing house and will be constructed on the existing slab. The only other work to be done will be a small addition to the driveway. The plan calls for a stone trench to accommodate any increase in run-off from the additional driveway surface. The existing garage will not be replaced. The new house will be hooked to the existing septic system. Allwork is outside the 25 ft. buffer zone. Paul made the motion to accept the plan as drawn, dated December 18, 2008, for 260 Plain Street and to issue an Order of Conditions with the following stipulations: Michele is to be notified prior to the start of construction and siltation control is to be in place and inspected before any work begins. If there are any changes to the plan, the applicant will need to come back before the board for approval. Carole seconded. Passed 4-0. Hearing ended at 7:15 pm. I. 3. · Discussion: 23 Riverside Drive. Mr. Lei, the homeowner, was not present. Mr. Lei is putting an addition on his house and does not need to file with Conservation for the addition but Mr. Lei would like to use any dirt displaced by the construction of the addition to level out his property. There is a large pond in the back of the property The back yard has a slope more than 2-1. Michele told Mr. Lei he would have to stay 25 ft. from the pond and would not have to file. Because Mr. Lei was not present, the Commission decided to table the hearing until Michele returns to discuss 23 Riverside Drive. Paul made the motion to table the hearing for 23 Riverside Drive pending further discussion with Michele and until Mr. Lei is present. Derek seconded. Passed 4-0. Hearing ended at 7:20 pm. 4. Certificate of Compliance: GourdinEstates, Red Mill Realty Trust, MiUStreet, Lot 10, Patriots Way. DEP #211-689 (for the development). This hearing was continued from December 2008 at which time the request for a certificate of compliance was tabled because no representative was present and the board requested more information. Because there was not a representative at tonight's meeting and the board would like more information, the board decided to tabled the hearing until 1 anuary 26, 2009. Paul made the motion to table the hearing for the request for a certificate of compliance for Patriots Way until the conservation agent and a representative are present. Carole seconded. Passed 4-0. Hearing ended at 7:25 pm. 15. .... Other Business 1) Kingman Pond Dam Update: Michele has made numerous visits to the dam and there are no issues. Hay bales have been replaced and are in place and no work has occurred outside the hay bale line. Paul talked with 10hn Sullivan, Town Engineer, and everything is on schedule. Paul suggested Conservation might want to issue a partial COC because payment might not be able to be made for the work done if not totally complete; there is stabilization and other issues to be done. 2) Alan Brown, 701 North Main Street - #21100820 - Mr. Brown was notified the Order of Conditions stands as written - a 5-ft. high chain-link fence with plantings approved by the conservation agent must be installed on the 50 ft. buffer 3) 69 King Street - #211-0807 - The Commission questioned who approved the location change. Derek feels the applicant changed what was approved in the Order of Conditions. It is a bigger house, in a different location in a flood zone. Derek feels it should have been considered new construction with no work in the 50 ft. He reminded the Commission the applicant was told if an alternative was found to building on the existing footprint, if the plans changed at all, they would have to re-file under new construction regulations; the applicant would be held to the 50 ft. instead of the 25 ft. 2 The Commission decided to wait for Michele to return to discuss 69 King Street. 4) Grant Money- Conservation received a letter from the Executive Office of Energy and Environmental Mfairs offering financial assistance to municipal conservation commissions for the acquisition of land for the purpose of conservation and passive recreation. The Local Acquisitions for Natural Diversity (LAND) Grant Program Second Round for Fiscal Year 2009 offers financial assistance to municipal conservation commissions for the acquisition of land for the purpose of conservation and passive recreation. Michele will check on money in account for buying land; there is a reimbursement of 54%-70% of the money we have available. Paul suggested calling Lenny Flynn to get NRT involved. Paul is especially interested in the Canoe River or Great Woods area. Paul feels it is important that Michele attend the workshop scheduled for February 25th concerning the grant. 5) Suzanne Estates - The land has been deeded to Conservation as of March 2008. 6) Autumn Park - Perry DiMascio wants to donate Common areas A and B, approximately 14 acres to Conservation. Common area B abuts conservation land. Both areas are off Feck Way with the proposed public roadway intersecting these areas. Some members of the Commission were concerned the land being donated was a protected habitat; it is not. Joe will contact Perry DiMascio.
