Dear Mr. Marhoffers
15 COUNTY STREET
MANSFIELD, MASSACHUSETTS 02048
In response to your letter of October 2, I am pleased to
report that our construction project was completed during
the third week of September. During the summer months we
accomplished the necessary land clearing and terrain height
above .river survey. The excavation was accomplished during
the weeks of September 8 and 15.
The facility consists of an L-shaped non -permeable barrier,
approximately 500' in length, extending from at least 6 inches
below the water table to the ground surface. A series of
covered pits are provided for inspection and removal of
contaminants.
The obvious purpose of waiting until September to accomplish
the excavations was to insure that the water table was at
its lowest point. Actually, based on our survey, it was
actually below the river level.
I was waiting to see what results I could report= however,
I now realize that I have been remiss in keeping your office
informed of our progress. Please accept my apologies.
Thank you for all your cooperation in this matter.
Yours very truly,
William E. Hayne

Dear Mr. Walsh,
RE: Mansfield (TNT)
Rumford River
Hatheway & Patterson Co. Inc.
This office is in receipt of your letter dated December 29, 1981 relative
to testing in the vicinity of Hatheway & Patterson Co. Inc. As you are aware,
you and a consultant for the Grossman property collected several samples of
subsurface materials related to the recent discovery of oil on the groundwater.
This Department was informed by Mr. Haynes of Hatheway & Patterson Co. Inc. at
the meeting on January 5, 1982, that his firm was pursuing analyses of these
samples. As part of this Department's recent letter to the firm, they have
been required to analyze these samples and forward a report to this Department,
relative to the results, prior to March 1, 1982.
This office will make the above report available to you for your review,
and based upon our joint review, a determination will be made relative to the
need for further sampling of subsurface materials. In the interim, this office
will collect samples in the river upstream and downstream of the oil situation
and provide you with these results as soon as they become available.
During a spill .'incident in December, 1972, this Department collected
samples of subsurface materials in this same general area for the purpose of
identifying the source of spillage. An analysis of the oil associated with
this spill indicated that it was No. 2 fuel oil containing a low percentage of
the wood preservative pentachlorophenol (3.66%). Recent observations in the
same area have indicated that similar oils may still exist in the ground as
well as other types, perhaps from other sources.
Should you have further questions relative to this matter or desire
additional information relative to your letter dated December 29, 1981, please
do not hesitate to contact me or Robert Donovan, Southeast Regional Hazardous
Waste Coordinator., (617) 947-1231 ext. 680--,684.
Very truly yours,

ATTENTION: William E. Haynes, President
Gentlemen:
January 18, 1982
RE: MANSFIELD--Hazardous Waste --Notice
of Violation, 315 CMR 2.03
Hatheway & Patterson Co., Inc.
An engineer from the Department, in conjunction with the Director of the
Mansfield Public Health Department, investigated your property and the Grossman
property, located across the railroad track from your facility, on December 21,
1981.
During this investigation, the following conditions were observed:
1. Substantially recoverable oily wastes were present within the
wooden barrier immediately adjacent to the river.
2. Discoloration at the most downstream end of the wooden barrier
represented the escape of some oily wastes to the river.
3. A test hole to groundwater depth, located about 100 feet south
from the L-shaped, non -permeable barrier, showed the presence
of a slick of oily wastes upon the groundwater. The character-
istics of this oil were similar to the oil which continues to seep
from the riverbank. Several other test holes excavated further
south from this location indicated similar results.
It is apparent that these conditions have resulted from the past, operation
of your firm, since the recent soil tests have revealed significant concentrations
of oily wastes similar to those controlled by your firm within the wooden structures
adjacent to the Rumford River.
These conditions constitute a violation of Section 2.03 of the Massachusetts
Hazardous Waste Regulations. These Regulations, as contained in 315 CMR 2.00,
were adopted under the provisions of Sections 27(8), 52, 57 and 58 of Chapter 21
of the General Laws or Sections 4 and 6 of Chapter 21C of the General Laws, as
applicable.

During a follow-up meeting with this Department at Hatheway & Patterson Co.,
Inc, on January 5, 1982, the following schedule was discussed and is henceforth
provided for your expeditious implementation:
1. Engage the services of a consulting engineer to perform exploratory
testing and report the extent of contamination, estimate the quantity
and classification of recoverable materials and propose a method of
recovery and disposal, prior to March 1, 1982.
2. Prior to March 15, 1982, engage the services of a licensed hazardous
waste contractor to oversee and implement the recovery and disposal
of underground materials.
3. As soon as weather and ground conditions are suitable, initiate
recovery activities within the areas affected by contaminated ground-
water.
It. Beginning one month following the initiation of recovery, submit
monthly status reports to this Department which indicate the following:
a. Daily recovered quantities listed specific to each
recovery location.
b. Quantities observed and removed at the L-shaped
impermeable barrier and at the riverbank barrier.
c. Total inventory of stored recovered oily wastes on -
site.
d. Total volume of oily wastes transported for disposal and
list the ultimate disposal locations engaged for the pre-
vious month.
Should early winter frost depths prohibit the accomplishment of Item 1 above,
then the schedule shall be revised as follows:
IA. Engage the services of a consulting engineer to review past
efforts of oily waste containment and recovery, assess the
extent of recently discovered oil quantities, including a
review of sample analyses and propose a method of exploratory
testing and tentative recovery. The above to be submitted to
this Department in the form of a report, prior to March 1, 1982.
2A. Engage the services of.a licensed hazardous waste contractor to
oversee and implement the recovery and disposal of underground
materials. The contractor is to attend a meeting with you and
your consulting engineer at this Department's office in Lakeville
on March 16, 1982 and shall be prepared at this time to discuss
required methods of waste handling and disposal,
-3-
3A. As soon as the weather and ground conditions are suitable, initiate
exploratory activity to determine the extent of contamination, estimate
the quantity of recoverable materials and finalize the method of
recovery and disposal. Summarize the above in the form of a report
and submit it to this office prior to May 1, 1982.
4A. Initiate clean-up and recovery activities rior to May 15, 1982>
and submit monthly reports as indicated in Item .
Should Hatheway & Patterson Co., Inc, fail to comply with the above schedule
and take any other actions determined necessary to cause compliance, the Department
will have no alternative other than to initiate appropriate enforcement mechanisms
as provided in Section 14 of Chapter 21 of the General Laws (Inserted by Chapter
705 of the Acts of 1979) or Section 10 of Chapter 21C of the General Laws (Inserted
by Chapter 704 of the Acts of 1979).
In addition to the above matter, this office requires that your firm's method
and/or frequency of removing oil at the river be significantly improved, so that
recoverable quantities are not allowed to remain within the barrier. Present
seasonal river height fluctuations threaten the downstream escape of additional
recoverable oily wastes if they are not promptly removed.
The Department requests that it be formally informed of your intentions
relative to these matters on or before February 5, 1982.
Very truly yours,
For the Commissioner
Robert E. Donovan
