15 County Road (the "Site"),
APPROVAL OF PHASE II SCOPE OF WORK,
M.G.L. c. 21E, 310 CMR 40.000
The Department of Environmental Protection, Bureau of Waste Site Cleanup
(the "Department"), has reviewed a Revised Supplemental Phase II Scope of
Work for the Site (the "Supplemental SOW") prepared on your behalf (as used
in this letter "you" and "your" refer to Hatheway & Patterson Co., Inc.) by
Penney Engineering, Inc., and dated September 16, 1992. The Department
approves the Supplemental SOW with the following provisions:
1. Quarterly rounds of groundwater and surface water monitoring will
be accompanied by full rounds of gauging and the compilation of
areal flownets and will be continued until the Phase II Report is
approved by the Department. Phenols will be monitored by EPA
method 8040/604, while dissolved oxygen may be screened in the
field.
2. The Department shall be notified in a timely manner of each
response action planned at the site to insure the Department has an
opportunity to inspect work in progress.
3. Data compilations in the form of maps, cross -sections, flow nets,
borehole and completion diagrams, chain -of -custody forms, and
laboratory analytical results and verifications shall be submitted
to the Department in monthly progress reports that also detail the
implementation of the SOW.
4. If during the implementation of the SOW a determination is made
that additional work plans are needed to complete the Phase II
Activities outlined in 310 CMR 40.545(3), a supplemental work plan
and schedule shall be submitted for approval to the Department.
5. Monitoring and observation wells which are damaged, destroyed, lost
or inadequately completed shall be replaced within two weeks.

6. The completion of a Phase II - Comprehensive Site Assessment
carried out in conformance with the SOW approved by the Department
must be followed by the drafting and submittal of a Phase II Report
in compliance with 310 CMR 40.545(4). The Phase II Report shall
include the results of all previous work on and near the site in
addition to all the items listed under 310 CMR 40.545(4)(a) through
(1).
7. The Department shall be notified immediately whenever access,
permits or authorizations are unreasonably withheld during the
execution of a Phase II - Comprehensive Site Assessment.
The Department requires a written response within fourteen (14) days of
receipt of this letter indicating whether you intend to take the actions
outlined above (as used in this letter "you" and "your" refer to HPC Realty
Trust and its trustees).
You have been previously notified of your liability in the Notice of
Responsibility letter dated August 16, 1968.
