D'Agostino and Leite: On behalf of Pratt Street Realty, Inc and in accordance with the public involvement requirements specified in the Massachusetts Contingency Plan, Penney Engineering, Inc is hereby providing notification to your offices of the availability of a combined Release Abatement Measure (RAM) Completion Report and a Response Action Outcome (RAO) Statement for its property at 12 Pratt Street. On November 7, 2000, the Department of Environmental Protection ("the DEP") was notified of contaminated soil around an underground heating oil/waste oil tank. On February 5, 2001, the DEP was also notified of contaminated soil and groundwater around a dry well. In August 2001, Penney Engineering was requested to review the site conditions and complete limited groundwater and soil sampling. The findings of our assessment indicated that the significant soil and groundwater contamination at the site required that response actions be conducted. A total of approximately 686 cubic yards of contaminated soil was removed from the property. Remedial additives were applied to the groundwater and the groundwater was periodically sampled. A condition of no significant risk of harm to human health, safety, public welfare and the environment has been achieved at the property. No imminent hazards to the health and welfare of the public have been identified at the property. Local officials may obtain copies of the combined RAM Completion Report and RAO Statement by contacting the DEP Southeast Regional Office at (508) 946-2714 and referring to Release Tracking Number 4-15838. Remedial additives were added to the excavation, mixed and. baekfilled, However, no upgradient monitoring point was included per 40.0046(4)(b). Groundwater monitoring was conducted periodically on two to three wells (AET-2, 3 & 8) for volatile petroleum hydrocarbons (VPHs), extractable petroleum hydrocarbons (EPHs) and/or remedial measurements (dissolved oxygen, pH, temperature, & bacteria) from January 2002 through March 2005, Remedial additives were added to wells AET-2, AFT-3 and MW-1 from January 2002 through March 11, 2005. The last groundwater measurements for remedial additive by- products was March 23, 2005, There is no corrective action required for these violations at this time. However, these violations may be used to establish a pattem of noncompliance if future enforcement actions are pursued. Violation of 310 CMR 40.1004 Klass 111 —Performance Standards for Response Action Outcomes A Response Action Outcome shall be supported by assessments and evaluations pursuant to 310 CMR 40.0000 which are: a) of sufficient scope, detail and level of effort to characterize the risk of harm to health, safety, public welfare and the environment posed by the disposal site pursuant to 310 CMR 40,0900; b) are consistent with the Response Action Performance Standard described in 310 CMR 40.0191; o) are commensurate with the nature and extent of the release and complexity of site conditions; d) demonstrate that all the requirements of the applicable class of RAO pursuant to 310 CMR 40.1000 have been met, and; e) conform with the applicable requirements and procedures for conducting response actions specified in 310 CMR 40.0000. The nature and extent of groundwater contamination at the site has not been adequately delineated. According to the RAO, PCB -impacted soil was encountered in the waste oil/beating oil LIST area and a PCB concentration of 0.67 ppb from well AET-5 exceeded the Method 1 GW-3 standard, This PCB concentration was not acknowledged as an exceedance of the Method 1 GW-3 standard in the RAO report and no further samplinglanalysis for PCBs was conducted for this well. In addition, no information was provided to substantiate that soil and groundwater samples in the vicinity of the former gasoline USTs and dispenser were analyzed for EDB. Monitoring of well AET-2 from March 2002 through April 2004 for VPHs identified VPH Oct, 30. 2007 2:10PM MASS DEP No, 2153 P. 7/9 Mansfield, RTN: 4-15838 NOTICE OF AUDIT FINDINGS AND Page 6 NOTICE OF NONCOMPLIANCE concentrations that exceeded the Method 1 GW-2 standards. This well appeared to be within thirty (30) feet of the former garage but was destroyed in the Spring 2004 and the office/apartment building was constructed on the southern part of the site and above this well. This monitoring. -well- was not replaced with a collocated well and no further monitoring .was .. -- conducted. In addition, an evaluation of the potential impacts to indoor air for the recently constructed commercial/residential building above this area was not conducted. Violation of 310 CMR 40,0017(1) (Class II) — Environmental Sample Collection and Analvsis Any person undertaking response actions under the provisions of the MCP shall ensure that analytical and environmental monitoring data used in support of recommendations, conclusions, or LSP Opinions with respect to assessment, removal, or containment actions is scientifically valid and defensible, and of a level of precision and accuracy commensurate with its stated or intended use. In June 2002 well AFT-2 was sampled for PCBs. however, the reporting limits were noted as 1 ppb and the Method 1 GW-3 standard is 0.3 ppb for PCBs. In addition, no reporting limit was noted for the December 2000 PCB sampling of this well and the laboratory reports were not appended to the RAO. Additional information submitted subsequent to the August 2, 2007 site inspection indicated that analysis of EDB in soils had been conducted and no EDB was detected above the detection limits of 0.2 ppm. However, the Method I S-I/GW-2 and S-1/GW-3 standards for EDB are 0.01 ppm, In addition, no boring logs/test pit logs were included in the RAO to support the assertions that the elevated lead concentrations identified in the heating oil/waste oil UST area and the drywell area were attributable to urban fill. Violation of 310 CMR 40.0974 Class III_ Identification of Applicable Groundwater Categories The groundwater categories (GW-I, GW-2, and/or GW-3) identified for the disposal site per 310 CMR 40.0932 shall determine which columns of numerical standards listed in Table 1 are applicable to the groundwater. If multiple categories apply to the groundwater at the disposal site, the lowest of the applicable MCP Method 1 groundwater standards shall be used to characterize the risk of harm posed by the oil and/or hazardous materials at the disposal site. Although the Method 1 risk characterization notes that all groundwater is classified as GW-3, it later states that the applicable groundwater standards are GW-2 for the site. Some tables in the RAO present both Method 1 OW-2 and GW-3 standards, however, some only present the GW-2 standards for comparison to determine No Significant Risk, Violation of 310 CMR 40.1003(4) Class 11 --Disposal Site Boundaries The location of a site for which an RAO applies shall be clearly and accurately identified in the RAO Statement. The boundaries of a disposal site or portion of a disposal site for which an RAO applies shall be clearly and accurately delineated and provided in documentation submitted with the RAO Statement, The RAO Site Plan in the RAO does not depict the boundaries of the disposal site.
