Dear Mr. & Mrs. Oliveira:
.J have witnessed sewage discharge to the basement of your property at
80-82 North Main Street,;}Mansfield, on March 21, 1988.
This is a violation of 105 CMR 410.300, State Sanitary Code, Chapter 11:
Minimum Standards of Fitness for Human Habitation; Sanitary Drainage
System Required and 310 CMR 15.02(20): the State Environmental Code,
Title 5: Minimum Requirements for the Subsurface Disposal of Sanitary
Sewage, General Requirements; Discharge to Surface of the Ground.
Under the 100 CMR 400.200(B) State Sanitary Code 1: General Administrative
Procedures, Local Enforcement; Emergency Procedures and the 310 CMR 11.05(1)
Environmental Code, Title 1: General Application and Administration,
Emergency General, I am declaring the above situation an emergency, which
may endanger or impair public health.
You are hereby ordered to immediately correct the emergency by repairing
the septic system.
Under the terms of the State Enviornmental and Sanitary Codes, you are
required to correct this violation. We ask your cooperation in doing so.
You have five (5) days to correct this problem by repairing the system.
You may also request a hearing, and it is your responsibility to request
the same by filing, in writing, a request within seven (7) days of receipt
of this notice to the Mansfield Health Department.
