Mr. Aptowitz asked if the details of the RFP agreement will come before the Select Board. Mr. Dumas said an appointed Committee will go through the review processes, and then it will come before the Select Board. Mr. Schoonveld stated that he feels it would make sense to give the Board an impression of what the details of the agreement might be, even if it is in Executive Session, as if the bid is less than what the Board was expecting then he's going to have a problem with that given the Town's budget constraints. Mansfield Cable agreement — Mr. LaCasse has been working on developing a formal agreement between the Town and Mansfield Cable Access as this was one of the items identified in the Town's audit. This program will work with the Town Manager to help develop outreach strategies. A goal is for the Town to become a partner with these businesses, who may need to re-strategize, to help them be successful. Also, Phase II will help highlight Mansfield as a potential future home for companies in the life sciences and biotech industry. There will be four primary steps, 1. Reconfirm BiodiverCity's commitment, 2. Work with the Town Manager to setup meetings to collaborate and assist BiodiverCity's leaders, 3. Establish a Mansfield Life Science Task Force, 4. Provide creative assistance to the Mansfield as a result of what might come out of the Task force discussions and needs. Ms. Penta noted that Mansfield is a Gold - Ready community, she is hoping to open more doors by helping Mansfield to become a Platinum -Ready community. Another facet of the Economic Development initiatives will be to direct and support marketing/outreach communications of Economic Development. This will include helping develop an Economic Development position for Mansfield. Ms. Penta also reviewed the recent notable topics for in the moment social media postings for things going on in Town that showcased awards, highlights, and headlines of items that make Mansfield desirable to companies. She then informed the Board of the Costar tool Mansfield has purchased which is used for researching commercial leases expirations in Mansfield and other communities, so Mansfield can be talking to current businesses in Town and to reach out to businesses in other communities who may be looking to move. 5. Public Hearing in Accordance of M.G.L. Chapter 140 Section 157 for a Dangerous Dog Complaint made by Robert and Susan Jean for a dog owned by Aaron Hyre Mr. Aptowitz read the public hearing notice for the record. Motion: To open the public hearing. (Aptowitz/Trowbridge) Schoonveld —Yes, Aptowitz —Yes, Rhein —Yes, Trowbridge — Yes, DelVecchio —Yes Passes 5:0 Town Clerk Marianne Staples sworn in Animal Control Officer, Jeff Collins, Robert & Susan Jean, and Aaron Hyre Mrs. Susan Jean gave her statement of the account of the dog attacks which included testimony that her husband was walking their dog on a leash on their own property when Peanut the dog attached her cockapoo resulting in substantial injuries which Mr. Hyre paid the veterinarian bills for. Mrs. Jean stated that this was the second incident between the dogs. The first one was three years ago and her dog was off the lease during the previous incident. She stated that it made her feel unsafe in her own yard with her dog. She stated that her husband kicked Peanut during the second incident in an effort to stop the attack. She understands that the dog has been re -homed, but she is concerned that the dog may be allowed to return. Questions: Mr. Schoonveld and Mr. Trowbridge had no questions for Mrs. Jean. Mr. Aptowitz clarified that Ms. Jean's dog was off -leash three years ago. Ms. lean stated that was true, her dog Nala was off -leash and over the stone wall property boundary by about one foot in a previous incident that was reported, and that there was another incident where Mrs. Jean was sitting on her front steps with Nala on a leash and Peanut tried to attack Nala and this incident was not reported. Mr. Hyre stated that Peanut has shown no aggression toward any other people or animals, including dogs owned by friends and their own other pets. He stated that he lives on a very busy dog -walking street and he has never had any issues with peanut barking, chasing, or pursuing any other dogs or people. He added, he has spoken to many people walking by his property and none reported having any issues with his dogs chasing the fence, barking, or feeling Select Board Meeting Minutes December 16, 2020 threatened in anyway. Mr. Hyre clarified that the incident in which Nala came onto his property, she was not just over the stone wall by one foot. He stated that Nala was over the property line by about 25 feet. Mr. Hyre stated that it is his opinion that Peanut is not animal or dog aggressive, but unfortunately there is some kind of trigger with Nala. In talking through this with the Jean's and Animal Control Officer Jeff Collins, Mr. Hyre's family made the very difficult decision to permanently transfer ownership and rehome Peanut, outside of Mansfield to a family he does not know. This was in consideration of the Jean's and how they felt. He emphasized the impact to his family. Mr. Schoonveld stated that if these property owners are going to continue to have dogs that they should consider putting up a fence. Mr. Hyre stated that after the 2017 incident he put up over 200 feet of containment fencing. He added that the Jean's have also put up a fence. Mr. Hyre added that the new dog owners are fully aware of reason why the dog needed to be rehomed and as part of the transfer of the ownership of the dog the recommendation was made to see training to re -socialize the dog. Mr. Aptowitz stated that both parties are being reasonable and Mr. Hyre has done his due -diligence and has stated that the ownership of the dog has been transferred. Mr. Trowbridge, Mr. Rhein, and Mr. Dumas had no questions. Jeff Collins, Animal Control stated back in August of 2017 there was an incident. Mr. Collins stated that in that incident had Peanut wanted to cause harm to Nala there would have been more significant injuries. He continued, in this recent incident there were some abrasions and a puncture wound. Mr. Collins noted that Peanut did not redirect the attack to Mr. lean when Mr. Jean kicked Peanut which in Mr. Collins' opinion shows there is no aggression toward Mr. Jean. Mr. Collins stated that had he been asked to make a recommendation it would have been that the dog be deemed a nuisance, and that the dog be taken out only on a leash. Or, possibly that Mr. Hyre put up fencing around his entire property. Mr. Collins stated that he has had no prior incidents with any other incidents involving Peanut other than what has happened with Nala. Questions: Mr. Schoonveld asked what the rating be of this wound according to Mr. Collins examination. Mr. Collins said that it is either a three or a four as there would have been a more serious wound if Peanut had bit down. Mr. Aptowitz asked how the Jean's dog is doing. Ms. Jean said that she is good, but she could lose her leg if anything like this happens again. Mr. Jean noted that they have spent $10,000 on a higher full fence on the entire property, and she is never off leash in the front of the property. Mr. Hyre wanted clarification on the rating of wound because he thought Mr. Collins had stated something different in a past conversation. Mr. Collins clarified that it is at least a three because it is a canine wound and could be up to a four. Mr. Rhein and Mr. DelVecchio had no questions. Mr. DelVecchio asked Mr. Collins for his recommendations. He said if the dog was still on the property, he would have recommended fencing away from the Jean's property or the requirement of being on a lead when it is outside, not an electronic fence. Mr. Trowbridge asked the Jean's how they feel knowing the dog has been re -homed outside of Mansfield. Mrs. lean said that she feels fine with the outcome. She stated she needed the assurance that the dog will not be returning and that is why she filed the complaint. Mr. Collins wanted to note that Mr. Hyre quarantine the dog until the 11' and that is why the dog was not re -homed sooner. Mr. Rhein asked Mr. Collins if he would recommend calling this a nuisance or dangerous dog. Mr. Collins said if he was asked he would say it is a nuisance dog. Mr. Schoonveld asked Mr. Collins if the Town of Mansfield has an obligation to the town where the dog has been rehomed. Mr. Collins stated that if the dog is declared dangerous that classification follows the dog anywhere in the State and the Animal Health Officer in that Town would be notified. Mr. Paul DeRensis, Town Counsel made the recommendation to get the location of the dog. Mr. Hyre stated that he would defer that question to his attorney. Motion: To close the public hearing. He summarized that their Restaurant Manager has been unable to return to work because of medical reasons. They have brought Training Manager Shane Hall in to take over for the previous manager. Mr. Schoonveld stated that he is concerned that the former manager has not been at the location for almost a full year. Mr. Brodeur stated that he notified their licensing department as soon as they had received notification from the former manager that he was not returning. Mr. Brodeur recently learned that BWW's licensing department did not communicate with the Town within the 72 hours as the Town requires. Mr. Brodeur apologized and took full responsibility. Mr. Aptowitz stated that he considered it the District Manager's responsibility to notify the Board when there is a change of manager within the 72-hour timeframe. He also warned that he is going to remember this situation and will consider strict penalties in future if this happens again. Motion: To approve the change of manager application for Buffalo Wild Wings. (Aptowitz/Rhein) Rhein —Yes, Schoonveld — No, Trowbridge —Yes, Aptowitz —Yes, DelVecchio —Yes Passes 4:1 8. Discussion and Consideration of Remote Meeting Host/Minutes Clerk Job Description Mr. Dumas stated that since the onset of Covid we have transformed some of the minutes clerks into Remote Meeting Hosts who are acting as moderators for the virtual board and committee meetings. He also noted, that we have difficulty keeping minutes clerks because they only get a few hours each month, so this is formed to address our current and future needs to be able to keep the virtual meeting platform going. Select Board Meeting Minutes December 16, 2020 Motion: To approve the Remote Meeting Host/Minutes Clerk Job Description. (Aptowitz/Trowbridge) Discussion: Mr. Rhein asked if all Boards and Committee have minutes taker and how is it decided which boards get admin support. Mr. Dumas said the Boards with more administrative responsibilities have minutes clerks who help with minutes, positing, and other admin duties. Mr. Aptowitz stated that it is very difficult to participate in the meeting and take minutes, so it was decided to bring in minutes clerks. Rhein —Yes, Trowbridge —Yes, Schoonveld —Yes, Aptowitz —Yes, DelVecchio —Yes Passes 5:0 9. Warn to Adopt Select Board Agenda Policy This will be moved to the next Select Board meeting for consideration. 10. Discussion and Consideration to Adopt Revised Select Board Policy on Board and Committee Reappointments Revisions will be sent to the sub -committee of Mr. Trowbridge and Mr. Rhein, and then this will be moved to the next Select Board meeting for consideration. 11. Discussion of Parking Study and Parking Regulations Mr. Dumas updated that the last public discussion on the proposed parking plan has taken place. He said, one resident came forward regarding parking issues that might occur on Pleasant Street, Cottage Street, and Church Street because of the narrowness of the streets. Mr. Dumas said he walked the area with public safety officials to get their insight on the issues brought forward by the resident. He is asking if it is the pleasure of the Board to make changes to the parking regulations on those streets before moving forward with finalizing the parking plan, or would it be the Board's pleasure to adopt the policy as is and then take into consideration reviewing these areas and then proposing possible changes to the plan that has been put in place. Chairman DelVecchio stated because this plan is more restrictive, his preference would be to move on this. He asked for questions and comments from the Board. Mr. Schoonveld asked if the Chiefs agreed that this is an issue. Mr. Dumas said the feedback was that if the changes were to be done it would need to be expanded to most of the other streets in the Back Bay. Mr. Dumas said while it is important to get parking regulations on the books, it is also important to dive in and make sure it is right. It is important to look at it closely to really know what we are dealing with, but he acknowledged that is going to take time. Mr. Schoonveld suggested that perhaps we move forward with the plan, but then look more closely at what changes might be needed. Mr. Dumas said if we were to make changes before adopting the recommended plan, we would need to notify the affected residents as this would be different than we advertised. Mr. Trowbridge and Mr. Rhein both stated that the Board needs to move forward even if there are issues that to be addressed once adopted. 12. Discussion and Consideration of Revised Goals and Objectives Chairman DelVecchio noted that the Board would address this on January 6, 2021. He suggested that there may be a need for an additional January meeting to allow for such items and keep the scheduled meetings from running long. 13. Resident Questions and Comments Sharon Friedman stated that her concern is that once this is done, she would like to know how the Board is going to go back and change it if there are issues to need to be addressed. She added that there is a brand-new building, apartments, and retail so we don't want to have to wait until there is a problem to deal with this issue. She suggested that one solution would be to have parking on both sides of the streets, but to make the streets one-way. She offered that before the parking plan is finalized some real thoughtful solutions should be put on the table. 16.
