Meeting called to orderat7:04pm. Bernie Raftery, the environmental consultant for this project was present. Fairfield Green at Mansfield L.P. is requesting a certificate of compliance for 792,840,860 & 864 West Street. Bernie Raftery and Michele have reviewed the project with a site walk. The project has been built according to the approved plan, including the replication areas. Buildings F and G are not complete at this time; all interior work needs to be done. Derek made the motion to issue a Certificate of Compliance to Fairfield Green at Mansfield L.P. per plan prepared by Daylor (now Tetra Tech Rizzo), titled Wetlands Mitigation As-Built Plan and dated November 18, 2008 with the following stipulations: Conservation is to be notified upon completion of building F and G to schedule a final site visit; applicant must provide a map showing the location of wetland protection signage; applicant must provide contact information for the landscaping/maintenance contractor; a report with photos must be submitted to conservation in the spring and fall of 2009 on the health and/or replacement of the replication area plantings. Carole seconded. Passed 5-0. Bernie Raftery will call Michele with the information concerning the landscaping/snow plowing contractor. Hearing ended at 7 :20 pm. RIM Engineering has requested a release on the Order of Conditions, issued September 24,2003, and a Certificate of Compliance be issued for property located at Gourdin Estates, on Mill Street, Lot 10. The requested signage has not been placed correctly-as shown on the plan dated May 23,2008; there are three sign locations shown 25 ft. off the edge of the vernal pool and isolated wetlands. A block retaining wall and a wrought iron fence has been added to the area. The area has been landscaped and the lawn re-established. Paul would like to table the hearing so Mich~le can explain about the property and a representative for the applicant can be present. Paul made the motion to table the hearing for the request of a Certificate of Compliance for Patriots Way, Lot 10, until a representative can be present. Linda seconded. Passed 5-0. Hearing ended at 7:25 pm. I 4. Discllssion-701 North Main Street ~ #211-0810-AIan Brown. Mr. Brown came into Conservation last week and asked if a chain-link fence is necessary for this property. He would like to only put a living fence on the 50 ft. line. The original Order of Conditions asked for a 5 ft. chain-link fence to be placed on the 50 ft. buffer with plantings approved by Michele placed along the fence. Signage reading "Environmentally Sensitive Are-Do Not Disturb" is to be placed as follows: two signs are to be placed on the comers of the property with an additional two placed equally apart across the chain link fence. The Commission wants the Order of Conditions to remain as is. Paul said the fence was to maintain the integrity of the 50 ft. on touch. Carole is comfortable with the way it is but would like to amend the Order to "solid chain link fence, no gates." Joe and Paul do not feel the gate can be added as a condition at this point in time. Michele will contact Mr. Brown to let him know the conditions stand as far as the fence is concerned. Hearing ended at 7:37 pm. 69 King Street (#211-0807): Derek told the Commission the house has not bee~ built on the existing footprint as per the Order of Conditions dated May 14, 2008. He said the house is not even close to what was approved. It is bigger and overhangs the foundation by 2 ft. It is now located in the middle of the property. This property is within a flood plain. At the hearing of May 12, 2008, the plan was submitted with no compensation for the flood area. (when you alter land within a flood zone, you have to compensate somewhere else to replace the flood area, at an equal level) Ralph Maloon of RIM Engineering told the Commission there might be an alternative to building on the existing footprint and if it could be worked out, the applicant would be able to put a larger house in a different location on the site. If an alternative was found, the applicant would be required to re- file because the house would not be built on the existing footprint. The applicant, if an alternative is found, would re-file/submit plans under new construction regulations; he would be held to the 50 ft instead of the 25 ft. The building permit will be checked tomorrow. Derek would like to follow up on the Maple Street Park Memorial for Mr. Robert Hardy. He wanted to know it there was any response from the Board of Selectmen. The secretary will be contacted tomorrow. Paul would like a copy of the letter Michele sent to the Selectmen given to John Hogan. The Commission members were given a copy ofthe National Grid scheduled vegetation management treatments on rights-of way for 2009. Paul made the motion to accept minutes of November 17, 2008 as published. Derek seconded. Passed 5-0. I. 6. Adjournment:. Motion to adjourn at 7:47 pm: Carole/Paul- 5-0.
